For the purpose of these Terms and Conditions, the website owner will be hereinafter referred to as Nomad Balkans.

This website has been created by Nomad Balkans for informational purposes and for the personal use of users. Through these conditions of access and use of the website, it is intended to regulate the access and use of this website, as well as the relationship between the website and its users. By accessing this website, the following terms and conditions are accepted: access to this website is the sole responsibility of the users. Simply accessing this website does not imply any kind of commercial relationship between Nomad Balkans and the user.

 

Accessing and browsing this website implies accepting and knowing the legal warnings, conditions and terms of use contained therein.

 

The owner of the website may offer services or products that may be subject to their own particular conditions that, depending on the case, replace, complete and / or modify these conditions, and about which the user will be informed in each specific case.

 

 

ACCESS POLICY, TERMS OF USE AND WITHDRAWAL POLICY

 

This section includes information on the conditions of access and use of this website that must be known by the user. Information necessary for the purposes provided for in Law 34/2002 on Information Society Services and Electronic Commerce.

 

Nomad Balkans reserves the right to deny or withdraw access to its website, at any time and without prior notice, to those users who breach these General Terms or the particular conditions that may be applicable.

 

 

APPLICABLE LEGISLATION

 

These General Conditions are governed by Spanish legislation.

1. PROVIDED SERVICES

 

Nomad Balkans is a Tour Operator that designs and sells travel packages to groups and individuals. Such packages include a variety of services including, but not limited to, accommodation, transportation, activities and complementary travel services.

 

For the purpose of delivering these services, Nomad Balkans contracts different service providers including, but not limited to, hotels and guesthouses, tour operators, transportation companies and other travel services providers.

 

On the website, the users have the option to request and purchase the services offered by Nomad Balkans.

 

 

2. BOOKING

 

In order to make a reservation of the services and travel packages displayed in this website, users must submit a request to Nomad Balkans, either through email or by one of the web forms. After receiving the request, Nomad Balkans will send back by email a detailed proposal, based on user’s request.

 

In order to book the service or travel package, the user needs to pay a deposit. The amount of this deposit will be of 30% of the total amount of the package, unless mentioned differently in the package proposal or agreed otherwise.

 

 

3. PRICES

 

Nomad Balkans sends a quote for the travel package per person or for a group. This depends on the number of people, as well as services and arrangements included. The final price along with the services included are available for the customer to review on the proposal before proceeding to payment.

 

 

4. PAYMENT

 

After submitting the proposal, Nomad Balkans expects the customer to pay the deposit (30% of the total amount, unless agreed otherwise) and secure the booking within a maximum of 72 hours, unless mentioned differently. Otherwise, the offered prices, terms and conditions or the services included in the package might be subject to variations.

 

The remaining amount (70%) must be paid by customer not later than 3 weeks before trip start date, unless mentioned differently in the package proposal or agreed otherwise.

 

Nomad Balkans will also clearly indicate in the package proposal the available payment methods.

 

The customer may have to pay for some additional arrangements related to the services included in the package, such as – among others - deposit (accommodation, rent-a-car, etc.), extras and supplements or upgrade of service. Whenever possible, Nomad Balkans will provide precise information of any additional costs to customer beforehand.

 

 

5. CANCELLATIONS POLICY

 

Force Majeure circumstances:

 

Nomad Balkans shall not be liable or responsible for failure or delay in fulfilling or performing its obligations under the current Terms and Conditions when such failure or delay is caused by or results from causes beyond the reasonable control of Nomad Balkans. This includes, but is not limited to, floods, arsons, fires, embargoes, wars (declared and undeclared), insurrections, riots, civil commotions, strikes, lockouts or other labor disturbances, enactments or amendments of laws and regulations, omissions of Governments, including, but not limited to quarantine implementation measures, infectious disease outbreaks (including but not limited to the pandemic of COVID-19) or any technical catastrophes and accidents.

 

Nomad Balkans shall act in good faith and use reasonable commercial efforts to avoid or remove existing causes for non-performance of their duties. Nomad Balkans shall notify its customers in writing of any delay or failure to perform occurring from a Force Majeure. Nomad Balkans shall resume its obligations when it is considered reasonable after the cause of non-performance ceases to exist.

 

Covid-19 specific:

 

Nomad Balkans is committed to providing customers flexibility and security during the uncertain times caused by COVID-19 pandemic.

 

In the event of customer not being able to travel to the destination country due to lockdowns imposed or borders closure as a consequence of Covid-19, Nomad Balkans, acting in good faith, will provide - whenever this is possible - at least one of the following options: postponing travel start dates or a partial/full refund of the amount paid.

 

Nomad Balkans strongly recommends its customers to monitor notification of the Centers for Disease Control and Prevention for the latest information regarding COVID-19 before trip.

 

By booking a tour with Nomad Balkans during the COVID-19 pandemic, customers agree to the following:

  1. The COVID-19 pandemic is indisputably beyond Nomad Balkan’s control. It is customer’s sole responsibility to verify the latest domestic and international travel restrictions in connection with COVID-19. Nomad Balkans remains at customer’s disposal at all times and upon written request will be able to advise about the situation in the destination country. Failure to get familiarized with the latest rules and regulations concerning COVID-19 pandemics is customer’s sole responsibility.

  2. Being fully aware of the ongoing COVID-19 pandemic and the inherent risk to travel, customer is accepting not to hold Nomad Balkans liable for any travel restriction, cancellations, and delays by transportation, accommodation, excursions and other relevant providers.

  3. Customer understands that it is his/her sole responsibility to have travel insurance to ensure having coverage for all medical needs, trip cancellation, and other unpredictable changes to the trip. Customer also understands that concerns or fear of travel is not a covered reason for cancellation relating to COVID-19.

  4. Customer also understands that restrictive measures, including, but not limited to, the measures affecting destination country entry and departure regulations might change during trip, and in turn which might affect the trip. Customer will not hold Nomad Balkans responsible for the above.

  5. Customer is fully and personally responsible for his/her own safety and actions during trip and also recognizes that may be at risk of contracting COVID-19. Customer will not hold Nomad Balkans responsible for the above, therefore, in case there is a need for extending the trip due to imposed quarantine measures, all additional costs must be covered by customer.

  6. With full knowledge of the risks involved customer releases, waives, discharges Nomad Balkans from any and all liabilities, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, injury, or death, that may be sustained related to COVID-19 while on tour, participating in any activity, while during or in transit to/from the trip that may lead to unintentional exposure or harm due to COVID-19.

 

Other Cancellations Terms and Conditions:

 

Cancellations will only be accepted in writing, charges resulting therefrom will be based on the date this written cancellation is received.

 

Unless mentioned differently in the package proposal or agreed otherwise, the cancellation period and applicable refund will be as follows:

 

Up to 4 weeks before trip start date: 100% refund

 

4-2 weeks before trip start date: 70% refund of trip/package costs

 

2 weeks to 48 before trip start date: 50% refund of trip/package costs

 

Less than 48 hours before trip start date: no refund applicable

 

Nomad Balkans strongly recommends customers arranging travel insurance policy that covers cancellation for any reason.

 

 

6. BOOKING MODIFICATIONS

 

Modifications by customer:

 

Making changes to a booking is not always possible. In the event a change to a reservation is possible, the third-party suppliers (such as accommodation providers or tour operators) may charge an extra fee. The extra fees and cost differences are to be covered by the customer. This does not apply to adding excursions or other services to the travel package, but only to changes to existing confirmed bookings.

 

Modifications by Nomad Balkans:

 

In the event of Nomad Balkans or some of its suppliers not being able to deliver a service included in the proposal to customer, Nomad Balkans will replace it by another service of equal or greater value. If this is not possible, Nomad Balkans will reimburse the customer the amount of the given service.

 

 

7. INSURANCE

 

By agreeing to these Terms and Conditions customer understand that the trip will be secured by multiple providers, including, but not limited to accommodation facilities, tour providers, on-land transportations. Nomad Balkans is in charge of organizing the trip to be provided by vetted and trusted partners. For this reason, Nomad Balkans encourages all Customers to purchase personal travel insurance as Nomad Balkans is not liable for accidents, medical expenses, emergency repatriation, personal liability, cancellation, loss or damage to luggage or personal belongings, or excess luggage weight charges levied by airlines.

 

 

8. ACCOMMODATION

 

In the unlikely event that accommodation is unavailable upon arrival, Nomad Balkans reserves the right to make a substitution on customer behalf with accommodation of equal or greater value.

 

 

9. TRANSFERS

 

Transfers by car, minibus and/or coach bus, might be included depending on the travel package. Nomad Balkans is not responsible for missed transfers due to any events outside of their control, as for example flight delays or other problems including, but not limited to, time spent reporting damaged or lost baggage lost.

 

Should arrival flight be late causing customer to miss a transfer or connecting service, Nomad Balkans will assist in making alternative transfer arrangements, however, additional transfer costs may not be refunded and any additional expenses incurred shall be covered by the Customer.

 

 

10. DAY TRIPS AND ACTIVITIES

 

Nomad Balkans’ excursions and/or experiences may be subject to change(s) prior to or upon customer’s arrival at the designated destination. Whenever possible, Nomad Balkans will provide customer alternative options of equal or greater value.

 

Some of the trips and activities are subject to the weather conditions. In case these conditions are not favorable and the given trip or activity needs to be cancelled, an alternative option of equal or greater value will be provided or a refund of the full amount.

 

It is customer’s responsibility to arrive on time for the excursion or activity. If any excursion is missed due to tardiness, failure to meet at the designated check-in/pick-up area, and/or any other negligence on your behalf, Nomad Balkans cannot be held responsible and customer will not be eligible for a refund.

 

 

11. COMPLAINTS

 

If customer is not satisfied with any services, he/she must report this immediately to the Nomad Balkan. If the problem is not corrected during the trip, customer must submit a complaint, in writing via email within 15 days of completion of the trip. Nomad Balkans will work with the customer to address the stated problem in search for a resolution.

 

Nomad Balkans may not be held responsible for any promises made by accommodation owners, local guides, or anyone else who is not a Nomad Balkans employee.

 

 

12. INTELLECTUAL PROPERTY

 

All the contents of www.nomadbalkans.com are intellectual property and are protected according to the current national and international Intellectual Property legislation. The use of the content of this website is absolutely prohibited without the written authorization of Nomad Balkans.

 

It is forbidden to establish this page as a framework for others, however, a link to our Internet address (url address of the Web page) may be established as long as they are not related to false, inaccurate, incorrect statements that may lead to error or confusion or that are contrary to the law, morals or good customs.

 

The user may download the Web page on his terminal as long as it is for private use, without any commercial purpose, so he/she may not exploit, reproduce, distribute, modify, publicly communicate, assign, transform or use the content of the Web for purposes public or commercial.

 

The infringement of any of the aforementioned rights may constitute a violation of these provisions, as well as a crime punishable in accordance with article 270 and following of the Penal Code.

 

 

13. RESPONSIBILITY

 

Nomad Balkans contracts with a network of companies and individuals to assist in the provision of travel packages. These are independent third parties vetted and qualified to perform their respective assignments. All of these services, such as such as transfers, accommodation and excursions, are subject to third-parties terms and conditions. Nomad Balkans does not operate the buses, cars or accommodations used in its trip packages so it shall not be responsible for changes, delays and cancellations for such services.

 

Nomad Balkans shall not be held responsible for potential risks and dangers that customer may face in travel to destinations offered by Nomad Balkans, where injury, delay, or any other expected or unexpected events may occur. Nomad Balkans has no responsibility for any Customer who breaks any law or regulation of any country visited.

 

 

14 APPLICABLE LAW

 

These Terms and Conditions shall be governed and interpreted in accordance with the laws of the Kingdom of Spain.

 

In the event of a dispute regarding the Terms and Conditions, the Parties shall act in good faith to resolve the dispute amicably through negotiations.
